1. The agreement
By purchasing a service, you confirm that you are at least 18 years old and agree to these Terms, the Privacy Policy, and the Satisfaction Guarantee. “Monkeyfish Songs,” “we,” and “us” refer to the creative services operated by Jason Bellay in North Carolina.
2. Services and payment
Payment is due in full at checkout. Your selected service, price, rush option, and requested date appear before payment. Work begins after successful payment and receipt of the information needed to perform the service.
3. Timing and Rush Delivery
Published delivery windows are good-faith estimates measured from receipt of a complete questionnaire and any required materials. Sundays are not counted. A requested date inside the standard window requires the $79 Rush Delivery add-on and remains subject to availability. If we cannot accept a requested rush deadline, we will contact you promptly and offer a later date or refund the rush fee.
4. Creative process and revisions
- Personalized songs and songs from your lyrics include one lyric-stage update before production and one reasonable area revision after the preview.
- Lyric rewrites include one reasonable revision.
- Song or demo critiques include the written review described at checkout and do not include a rewritten song.
- Additional revisions are $45 each and begin only after your approval.
An “area revision” is a focused change such as strengthening a chorus or softening a bridge—not a complete restart, new story, or new creative direction.
5. Your materials and permissions
You promise that you have the right to provide the names, stories, lyrics, recordings, images, links, and other materials you submit. You remain responsible for their accuracy and legality. Do not submit confidential information belonging to someone else unless you have permission.
6. Human-led, AI-assisted creation
Jason personally directs the writing, editing, arrangement choices, and final creative judgment. AI-assisted tools may be used for production exploration, instrumentation, arrangement, or vocal presentation. Purchasing a service confirms that you understand and accept this process.
7. How you may use the final work
After full payment, you receive a perpetual, non-exclusive license to keep, play, gift, and share the final delivered work for personal, non-commercial purposes, including personal social-media posts. Commercial release, monetization, resale, advertising, synchronization, merchandise, trademark use, or representing the work as entirely created without AI assistance requires separate written permission. Drafts, unused versions, production files, methods, and pre-existing materials remain ours. We will not use your private story or finished work in marketing without separate permission.
8. Satisfaction, refunds, and cancellations
The Satisfaction Guarantee controls creative-quality refund requests. If you cancel before work begins, contact us immediately; we may refund the project price less non-refundable processing costs. Once work begins, cancellation refunds are not guaranteed. Rush fees are not refundable after priority work begins, except when we miss a confirmed rush deadline for reasons within our control.
9. Reasonable limits
We are not responsible for delays caused by incomplete information, late approvals, third-party outages, or events beyond reasonable control. To the extent allowed by law, our total liability for a project will not exceed the amount you paid for that project. Nothing here removes rights that cannot legally be waived.
10. Contact and governing law
Please contact us first so we can resolve any concern personally. These Terms are governed by the laws of North Carolina, without overriding any consumer protection that legally applies where you live.
